The matter is referred to the Commission by registered letter with acknowledgement of receipt sent to the Prefect.
This letter must be accompanied by a copy of the notification and the documents provided for in article L. 311-2 and, where applicable, a copy of the response to this notification and any additional submissions.
Within eight days of receipt, the Prefect will notify the other party in the same way, inviting it to provide the Commission within a fortnight with all evidence and documents likely to justify its point of view.
The commission, which may hear any person it deems qualified to enlighten it, must give its opinion within three months of the date of receipt of the request.
The parties are notified of the commission’s opinion in full by registered letter with acknowledgement of receipt.
After this notification, the tenant may proceed with the work for which the committee’s opinion is favourable.
Failure to notify three months after receipt of the request shall be deemed to constitute a favourable opinion.
