In establishments and organisations other than health establishments, by way of derogation, the Director General of the Regional Health Agency may authorise a doctor from the organisation, designated by name, to ensure the supply, holding, control and management of medicines and to dispense them directly to patients. This authorisation may only be granted for a replacement not exceeding three months or when the activity does not justify the presence of a full-time pharmacist.
For the purposes of this article, if the Director General of the Regional Health Agency remains silent, authorisation will be deemed to have been granted on expiry of a period of two months from the date of receipt of the application.
The medicinal products are held in a place to which persons not belonging to the organisation do not have free access and are stored under the conditions laid down in the marketing authorisation, under the responsibility of the doctor authorised by the Director General of the Regional Health Agency.
