Article R3122-22 of the French Public Health Code

Within one month of receipt of the letter referred to in Article R. 3122-21, the Office shall inform the president of the court concerned whether or not a claim for compensation with the same purpose has been lodged with it and, if so, the progress of the proceedings. It will also indicate whether or not it intends to intervene in the proceedings.

Where the victim has accepted the offer made by the Office, the Director shall send the president of the court a copy of the documents on which the settlement is based. The Office shall inform the parties of the status of any proceedings brought before the Paris Court of Appeal pursuant to the provisions of the articles in sub-section 1 of this section and shall communicate, where applicable, the judgment rendered by the court.

The parties are informed by the Registry or the Secretariat of the Registry of the information communicated by the Office.

Dans le délai d’un mois à compter de la réception de la lettre mentionnée à l’article R. 3122-21, l’office indique au président de la juridiction concernée, s’il a été ou non saisi d’une demande d’indemnisation ayant le même objet et dans l’affirmative, l’état d’avancement de la procédure. Il fait en outre savoir s’il entend ou non intervenir à l’instance.

Lorsque la victime a accepté l’offre faite par l’office, le directeur adresse au président de la juridiction copie des documents sur lesquels est fondée la transaction.L’office fait connaître le cas échéant l’état de la procédure engagée devant la cour d’appel de Paris en application des dispositions des articles de la sous-section 1 de la présente section et communique, s’il y a lieu, l’arrêt rendu par la cour.

Les parties sont informées par le greffe ou le secrétariat-greffe des éléments communiqués par l’office.
