Article R313-12 of the French Consumer Code

In order to be able, in the context of providing an advisory service, to recommend appropriate credit agreements to the borrower, the creditor or credit intermediary shall gather the necessary information on the borrower, on his personal and financial situation and on his preferences and objectives.

This recommendation is based on up-to-date information and on reasonable assumptions as to the risks incurred by the borrower during the term of the proposed contract.

This recommendation is made in the light of the borrower’s personal circumstances and financial situation.
This recommendation is drawn up with regard to a range of products comprising at least three separate credit agreements as defined in Article L. 313-1.

The lender or credit intermediary shall provide the borrower, on paper or any other durable medium, with the number of contracts examined and the names of the credit institutions or finance companies whose contracts have been examined, its recommendation and the reasons for its recommendation in the light of the information gathered.

Afin de pouvoir, dans le cadre de la fourniture d’un service de conseil, recommander à l’emprunteur les contrats de crédit appropriés, le prêteur ou l’intermédiaire de crédit recueille les informations nécessaires sur l’emprunteur, sur sa situation personnelle et financière ainsi que sur ses préférences et ses objectifs.


Cette recommandation est fondée sur des informations actualisées et sur des hypothèses raisonnables quant aux risques encourus par l’emprunteur pendant la durée du contrat proposé.


Cette recommandation est établie au regard d’une gamme de produits comportant au moins trois contrats distincts de crédits tels que définis à l’article L. 313-1.


Le prêteur ou l’intermédiaire de crédit fournit à l’emprunteur, sur support papier ou tout autre support durable, le nombre de contrats examinés et la dénomination des établissements de crédit ou des sociétés de financement dont les contrats ont été examinés, sa recommandation et la motivation de celle-ci au regard des informations recueillies.
