Article R3132-13 of the French Labour Code

The request to obtain one of the derogations provided for in articles L. 3132-14 and L. 3132-16 shall be accompanied by the necessary supporting documents and the opinion of the trade union delegates and the social and economic committee, if any. It is sent by the employer to the Labour Inspector.

The Labour Inspector will notify the employer and employee representatives of his decision within thirty days of receipt of the request.

La demande tendant à obtenir l’une des dérogations prévues aux articles L. 3132-14 et L. 3132-16 est accompagnée des justifications nécessaires et de l’avis des délégués syndicaux et du comité social et économique, s’il existe. Elle est adressée par l’employeur à l’inspecteur du travail.

L’inspecteur du travail fait connaître sa décision à l’employeur ainsi qu’aux représentants du personnel dans le délai de trente jours à compter de la date de la réception de la demande.
