Subsection 2: Exemptions from Sunday rest

Industries in which materials susceptible to very rapid alteration are used and those in which any interruption of work would result in the loss or depreciation of the product being manufactured, as well as the categories of establishments and establishments mentioned in the following table, are allowed, in application of article L. 3132-12, to give weekly rest in shifts for employees employed on the work or activities specified in this…

In the establishments mentioned in article R. 3132-5 where other industries or activities are carried out at the same time, the option of giving weekly rest by rotation applies exclusively to the production, work and activities determined in the table in that article.

In addition to the categories of establishments listed in article R. 3132-5, establishments operating day and night with alternating shifts which have suspended, for at least twelve consecutive hours each Sunday, work other than the urgent work and cleaning and maintenance work referred to in articles L. 3132-4 and L. 3132-8 are entitled to give weekly rest in shifts.

The establishments to which the provisions of article L. 3132-13 apply are those whose sole or main activity is the retail sale of foodstuffs.
