Article R3132-15 of the French Labour Code

The procedure laid down in articles R. 3132-13 and R. 3132-14 is applicable to the application for authorisation to exceed the maximum daily working time of ten hours in the event of recourse to substitute shifts pursuant to a company or establishment agreement.
It also applies to the request for authorisation submitted to the Labour Inspector in the absence of a company or establishment agreement providing for the use of the derogation stipulated by an agreement or extended collective agreement.

La procédure prévue aux articles R. 3132-13 et R. 3132-14 est applicable à la demande d’autorisation de dépasser la durée maximale quotidienne de travail de dix heures en cas de recours aux équipes de suppléance en application d’un accord d’entreprise ou d’établissement.
Elle s’applique également à la demande d’autorisation présentée à l’inspecteur du travail en l’absence d’accord d’entreprise ou d’établissement prévoyant l’utilisation de la dérogation stipulée par convention ou accord collectif étendu.
