Pursuant to article L. 321-1, the enforcement procedure is initiated by the service on the debtor or the third party holder of a summons to pay valid as a seizure at the request of the pursuing creditor.
En application de l’article L. 321-1, la procédure d’exécution est engagée par la signification au débiteur ou au tiers détenteur d’un commandement de payer valant saisie à la requête du créancier poursuivant.
La délivrance du commandement est un acte de disposition, réalisé aux risques du créancier.
Dans le cas où un immeuble appartenant en propre à l’un des époux constitue la résidence de la famille, le commandement est dénoncé à son conjoint, au plus tard le premier jour ouvrable suivant la signification de l’acte.
