Article R321-13 of the French Commercial code

The guarantor or the insurer shall only be liable if it is proven that the claim is certain, liquid and due and that the guaranteed operator has defaulted.

The guarantor may not set up the benefit of discussion against the creditor.

For the guarantor, the default of the guaranteed operator results from a summons to pay or to return followed by refusal or remaining unfruitful one month after it was served.

La caution ou l’assureur n’est tenu que s’il est justifié d’une créance certaine, liquide et exigible et de la défaillance de l’opérateur garanti.

La caution ne peut opposer au créancier le bénéfice de discussion.

Pour le garant, la défaillance de l’opérateur garanti résulte d’une sommation de payer ou de restituer suivie de refus ou demeurée infructueuse un mois après sa signification.
