Article R321-23 of the French Intellectual Property Code

The communication of the annual accounts of collective management organisations to the Minister responsible for culture pursuant to Article L. 326-10 must include:

1° The transparency report mentioned in article R. 321-14 ;

2° With regard to the implementation of actions whose funding is provided for by article L. 324-17 :

a) A breakdown of the amounts paid, by category of shares defined in the first paragraph of article L. 324-17, with specific information on :

– the cost of managing these actions;

– the people who have received assistance for three consecutive years;

b) A description of the allocation procedures;

c) A commentary on the guidelines followed by the organisation in this area;

d) The list of agreements mentioned in Article R. 321-7;

3° Annual information on any actions taken in defence of the professional categories concerned by their corporate purpose.

Article R321-23

La communication des comptes annuels des organismes de gestion collective au ministre chargé de la culture en application de l’article L. 326-10 doit comporter :

1° Le rapport de transparence mentionné à l’article R. 321-14 ;

2° En ce qui concerne la mise en œuvre des actions dont le financement est prévu par l’article L. 324-17 :

a) La ventilation des montants versés, par catégorie d’actions définies au premier alinéa de l’article L. 324-17, assortie d’une information particulière sur :

– le coût de la gestion de ces actions ;

– les personnes ayant bénéficié de concours pendant trois années consécutives ;

b) Une description des procédures d’attribution ;

c) Un commentaire des orientations suivies en la matière par l’organisme ;

d) La liste des conventions mentionnées à l’article R. 321-7 ;

3° Une information annuelle sur les actions éventuellement engagées pour la défense des catégories professionnelles concernées par leur objet social.
