Article R321-25 of the French Intellectual Property Code

I. – The authorisation referred to in II of Article L. 327-10 is issued, on an individual basis, by the chairman of the control commission to the commission’s rapporteurs and agents for a renewable period of five years.

To issue the authorisation, the chairman of the commission checks that the person concerned has the required skills and guarantees with regard to the tasks entrusted to the inspection board. In particular, he shall take into account the person’s level of training or experience.

II. – No person may be authorised if they have been convicted of a criminal or correctional offence entered in bulletin no. 2 of the criminal record, or in an equivalent document in the case of a national of the European Union or of another State party to the Agreement on the European Economic Area.

III. – Agents authorised under the conditions defined in this article shall take an oath before one of the two colleges of the Control Commission. The formula of the oath shall be as follows:

“I swear to perform my duties well and faithfully and not to reveal or use anything that comes to my knowledge in the course of their performance”.

A record shall be made of the taking of this oath.

Article R321-25

I. – L’habilitation mentionnée au II de l’article L. 327-10 est délivrée, de manière individuelle, par le président de la commission de contrôle aux rapporteurs et agents de la commission pour une durée de cinq ans renouvelable.

Pour délivrer l’habilitation, le président de la commission vérifie que l’intéressé présente les capacités et les garanties requises au regard des missions confiées au collège de contrôle. Il tient compte notamment de son niveau de formation ou de son expérience.

II. – Nul ne peut être habilité s’il a fait l’objet d’une condamnation à une peine correctionnelle ou criminelle inscrite au bulletin n° 2 du casier judiciaire, ou dans un document équivalent lorsqu’il s’agit d’un ressortissant de l’Union européenne ou d’un autre Etat partie à l’accord sur l’Espace économique européen.

III. – Les agents habilités dans les conditions définies au présent article prêtent serment devant l’un des deux collèges de la commission de contrôle. La formule de serment est la suivante :

“ Je jure de bien et fidèlement remplir mes fonctions et de ne rien révéler ou utiliser de ce qui sera porté à ma connaissance à l’occasion de leur exercice ”.

Il est dressé procès-verbal de l’accomplissement de cette prestation de serment.
