If a member of the Conseil des maisons de vente, a qualified person appointed or a representative of the profession elected, is unable to attend or resigns, he or she is replaced by his or her alternate from the date on which the inability to attend or the resignation is notified.
In the event of a vacancy in the seat of an appointed member and his alternate, they shall be replaced within a period of three months in accordance with the procedures laid down in Article L. 321-21.

If the seat of an elected member and his/her alternate becomes vacant, they are replaced by the first candidate and his/her alternate not elected at the time of the election of the representatives of the profession to the Conseil des maisons de vente. If there is no longer a candidate who was not elected, a by-election is held in accordance with the procedures set out in article R. 321-36-4. However, there is no need for this election if the vacancy occurs less than six months before the renewal of the college of the Conseil des maisons de vente.
The member thus appointed or elected shall hold office until the expiry of the current term of office of the resigning member whom he replaces.
The duties of a Board member are free of charge.
However, the members of the Board and the Government Commissioner are entitled to compensation for the expenses and hardships incurred in the performance of their duties.
