The Government Commissioner referred to in Article L. 321-23-1 is appointed by order of the Minister of Justice.
He participates in the meetings of the Board in an advisory capacity, subject to the specific provisions laid down in disciplinary matters in the second paragraph of Article R. 321-48.
It shall exercise its powers in disciplinary matters under the conditions set out in Articles R. 321-45 to R. 321-45-3 and R. 321-49-3 to R. 321-49-5.
It may lodge the appeal provided for in Article L. 321-23-3.
The person referred to in Article L. 321-23-3 of the Commercial Code shall be appointed by the Board of Directors.
The person mentioned in Article L. 321-23-1 assisting the Government Commissioner is appointed for a term of four years by order of the Minister of Justice, on the recommendation of the Conseil des Maisons de Vente. This position is incompatible with that of member of the Enforcement Committee.
This person provides the Government Commissioner with expertise on the rules of art and the practices of the profession. Their opinion is not binding on the Government Commissioner.
