The Chairman of the Conseil des maisons de vente or, after proceedings have been initiated before the Enforcement Committee, the Chairman of the Enforcement Committee who is considering imposing or extending a suspension measure pursuant to the second paragraph of III of article L. 321-23-2, shall summon the interested party by any means that confers a date certain. The summons shall state the grounds on which the professional is accused.
The person summoned may be informed of the reasons for the suspension.
The person summoned may consult the file, depending on the case, at the Conseil des maisons de vente or the Enforcement Committee.
The Chairman of the Conseil des Maisons de Vente or the Chairman of the Enforcement Committee, as the case may be, will give a reasoned decision after hearing the trader, the Government Commissioner and any other person he deems useful. The professional may be assisted or represented by a lawyer or an advocate at the Conseil d’Etat and the Cour de Cassation.
The decision is notified, by any means, to the Enforcement Committee.
The decision is notified to the professional and to the Government Commissioner by any means giving a date certain. It shall indicate the court before which it may be contested and the time limit for appeal.
The decision shall be notified by any means that confers a date certain to the professional and the Government Commissioner.
