Article R321-53 of the French Commercial code

The appeal is investigated and judged according to the rules applicable to the procedure without compulsory representation, the public prosecutor being heard. It shall be notified to the Conseil des maisons de vente and, where applicable, to the Enforcement Committee, to the professional concerned and to the Government Commissioner.

In the event of an appeal against the decisions of the Conseil des maisons de vente, its chairman or the chairman of the Enforcement Committee, the Conseil des maisons de vente is a party to the proceedings.

The parties have the option of being assisted or represented by a lawyer.

Le recours est instruit et jugé selon les règles applicables à la procédure sans représentation obligatoire, le ministère public entendu. Il est notifié au Conseil des maisons de vente et, le cas échéant, à la commission des sanctions, au professionnel concerné et au commissaire du Gouvernement.

En cas de recours contre les décisions du Conseil des maisons de vente, de son président ou du président de la commission des sanctions, le Conseil des maisons de vente est partie à l’instance.

Les parties ont la faculté de se faire assister ou représenter par un avocat.
