Article R321-71 of the French Commercial code

The Conseil des maisons de vente withdraws the authorisation for partial access to the activities of voluntary sale of furniture by public auction by reasoned decision:

1° In the event of failure to comply with 2° of I of Article L. 321-4 or for another reason based on a breach of public order;

2° In the event of permanent deprivation in the home Member State of the right to exercise the professional activity for which partial access has been authorised;

3° Where the conditions for partial access are no longer met.

The interested party is notified of the withdrawal decision by any means that confers a date of receipt.

Article R321-71

Le Conseil des maisons de vente retire l’autorisation d’accès partiel aux activités de vente volontaire de meubles aux enchères publiques par décision motivée :

1° En cas de manquement au 2° du I de l’article L. 321-4 ou pour un autre motif tiré d’une atteinte à l’ordre public ;

2° En cas de privation définitive dans l’Etat membre d’origine du droit d’exercer l’activité professionnelle pour laquelle un accès partiel a été autorisé ;

3° Lorsque les conditions de l’accès partiel ne sont plus remplies.

La décision de retrait est notifiée à l’intéressé par tout moyen conférant date certaine à sa réception.
