Article R3211-14 of the French Public Health Code

If he deems it necessary, the judge shall order any investigative measure, without debate if necessary.

When the judge orders two expert reports, the two experts carry out separate examinations of the person undergoing treatment.

The expert(s) appointed may not work in the establishment where the person undergoing psychiatric care is being admitted.

The experts submit their report within a period set by the judge, which may not exceed twelve days following their appointment. They are free to determine how the expert assessment is to be conducted. Notwithstanding articles 160 and 276 of the Code of Civil Procedure, they are not required to summon the parties or invite their observations. The report is filed with the court secretariat where the parties may consult it. At their request, the court registry will provide them with a copy.

S’il l’estime nécessaire, le juge ordonne, le cas échéant sans débat, toute mesure d’instruction.

Lorsque le juge ordonne deux expertises, les deux experts procèdent à des examens séparés de la personne qui fait l’objet de soins.

Le ou les experts désignés ne peuvent exercer dans l’établissement d’accueil de la personne qui fait l’objet de soins psychiatriques.

Les experts remettent leur rapport dans le délai fixé par le juge, qui ne peut excéder douze jours suivant leur désignation. Ils déterminent librement les modalités de conduite des opérations d’expertise. Par dérogation aux articles 160 et 276 du code de procédure civile, ils ne sont pas tenus de convoquer les parties ou de susciter leurs observations. Le rapport est déposé au secrétariat de la juridiction où les parties peuvent le consulter. Sur leur demande, le greffe leur en délivre une copie.
