Article R3211-15 of the French Public Health Code

At the hearing, the judge hears the applicant and the persons summoned pursuant to article R. 3211-13 or their representative, as well as the public prosecutor when he is the principal party. The persons notified are heard if they wish to speak.

If necessary, the judge will appoint a lawyer for the person undergoing psychiatric care.

The persons summoned or notified may submit their observations in writing, in which case the parties present at the hearing will be informed.

The judge may always order the parties to appear.

When it is not the main party, the public prosecutor makes his opinion known under the conditions defined by the second paragraph of article 431 of the Code of Civil Procedure.

A l’audience, le juge entend le requérant et les personnes convoquées en application de l’article R. 3211-13 ou leur représentant ainsi que le ministère public lorsqu’il est partie principale. Les personnes avisées sont entendues si elles souhaitent s’exprimer.

Le cas échéant, le juge commet un avocat d’office à la personne faisant l’objet de soins psychiatriques.

Les personnes convoquées ou avisées peuvent faire parvenir leurs observations par écrit, auquel cas il en est donné connaissance aux parties présentes à l’audience.

Le juge peut toujours ordonner la comparution des parties.

Lorsqu’il n’est pas partie principale, le ministère public fait connaître son avis dans les conditions définies par le deuxième alinéa de l’article 431 du code de procédure civile.
