Article R3211-17 of the French Public Health Code

If the judge decides to release the patient and the public prosecutor considers that he has no reason to oppose this release, the latter returns the order to the judge who issued it, stating that he has no objection to it being enforced. The measure to keep the patient at the disposal of the court is then immediately terminated, except in cases where the judge has deferred the effect of the release of the full hospitalisation measure.

Si le juge décide la mainlevée de la mesure de soins et que le procureur de la République estime ne pas avoir à s’opposer à cette mainlevée, ce dernier retourne l’ordonnance au juge qui l’a rendue en mentionnant sur celle-ci qu’il ne s’oppose pas à sa mise à exécution. Il est alors mis fin sans délai à la mesure de maintien à la disposition de la justice, sauf dans le cas où le juge a différé l’effet de la mainlevée de la mesure d’hospitalisation complète.
