Article R3211-19 of the French Public Health Code

The case shall be referred to the First President or his delegate by a reasoned statement of appeal sent by any means to the registry of the Court of Appeal. The statement shall be recorded, stating the date and time.

The Registrar of the Court of Appeal shall immediately notify the Registrar of the Court of First Instance who shall forward the file to him without delay.

The clerk of the court of appeal will inform the parties, their lawyers and, if they are not parties, the third party who requested admission to care and the director of the establishment of the date and time of the hearing by any means. The last two paragraphs of article R. 3211-13 are applicable.

Article R3211-19

Le premier président ou son délégué est saisi par une déclaration d’appel motivée transmise par tout moyen au greffe de la cour d’appel. La déclaration est enregistrée avec mention de la date et de l’heure.

Le greffier de la cour d’appel avise sur-le-champ le greffier du tribunal judiciaire qui lui transmet sans délai le dossier.

Le greffier de la cour d’appel fait connaître par tout moyen la date et l’heure de l’audience aux parties, à leurs avocats et, lorsqu’ils ne sont pas parties, au tiers qui a demandé l’admission en soins et au directeur d’établissement. Les deux derniers alinéas de l’article R. 3211-13 sont applicables.
