Article R3211-21 of the French Public Health Code

At the hearing, the parties and, where he is not a party, the third party who requested admission to psychiatric care may ask to be heard or submit their observations in writing, in which case the parties present at the hearing will be informed. The First President or his delegate may always order the parties to appear.

When it is not the main party, the Public Prosecutor’s Office makes its opinion known under the conditions defined by the second paragraph of article 431 of the Code of Civil Procedure.

A l’audience, les parties et, lorsqu’il n’est pas partie, le tiers qui a demandé l’admission en soins psychiatriques peuvent demander à être entendus ou faire parvenir leurs observations par écrit, auquel cas il en est donné connaissance aux parties présentes à l’audience. Le premier président ou son délégué peut toujours ordonner la comparution des parties.

Lorsqu’il n’est pas partie principale, le ministère public fait connaître son avis dans les conditions définies par le deuxième alinéa de l’article 431 du code de procédure civile.
