A collective management organisation governed by Title II of Book III may be approved under Article L. 122-10, if it meets the following conditions:
1° Demonstrate the diversity of its members on the basis of the categories and number of rightsholders, the economic importance expressed in terms of revenue or turnover and the diversity of editorial genres. This diversity must find its expression in the composition of the deliberative and governing bodies;
2° Justify, by any documents, the qualification of its managers and corporate officers assessed according to:
a) Their status as authors;
b) Or the nature and level of their diplomas;
c) Or their professional experience in the publishing sector or the management of professional bodies;
3° Give any information relating to its administrative organisation and the conditions of installation and equipment. This information must concern the collection of data on the practice of reprography, the collection of remuneration, the processing of the data necessary for the distribution of the remuneration collected, the financing plan and the provisional budget for the three financial years following the application for approval;
4° Provide in its articles of association, its general regulations and the standard deeds of engagement of each of its members the rules guaranteeing the equitable nature of the arrangements provided for the distribution of the remuneration collected by authors and publishers.
