Article R322-29 of the French Sports Code

Only PPE-SL may be imported, manufactured with a view to being placed on the Community market, held with a view to being sold or distributed free of charge, offered for sale, sold or distributed free of charge or made available free of charge or against payment if it :

1° Comply with the essential health and safety requirements relating to them;

2° Comply with the conformity assessment procedures applicable to them;

3° Bear the “CE” marking defined in article R. 322-34.

PPE-SL manufactured in accordance with the relevant standards, the references of which are published in the Official Journal of the European Union, benefit from a presumption of conformity with the essential health and safety requirements set out in Annex III-5.

The references of the national standards transposing the above standards are published in the Official Journal of the French Republic.

Article R322-29

Peuvent seuls être importés, fabriqués en vue de la mise sur le marché communautaire, détenus en vue de la vente ou de la distribution à titre gratuit, mis en vente, vendus ou distribués à titre gratuit, mis à disposition à titre gratuit ou onéreux les EPI-SL qui :

1° Sont conformes aux exigences essentielles de santé et de sécurité les concernant ;

2° Respectent les procédures d’évaluation de la conformité qui leur sont applicables ;

3° Sont revêtus du marquage ” CE ” défini à l’article R. 322-34.

Les EPI-SL fabriqués conformément aux normes les concernant, dont les références sont publiées au Journal officiel de l’Union européenne, bénéficient d’une présomption de conformité aux exigences essentielles de santé et de sécurité énoncées à l’annexe III-5.

Les références des normes nationales transposant les normes susvisées sont publiées au Journal officiel de la République française.
