Article R322-37 of the French Sports Code

The person responsible for hiring out or repeatedly making available second-hand PPE-SL must ensure that this PPE-SL meets the conditions specified by the manufacturer in the notice referred to in point 1.4 of annex III-5 of the regulatory part of the sports code.

An order issued by the ministers responsible for industry and labour respectively specifies the information available to this person in order to establish that the PPE-SL remains compliant. The person in charge will provide this information, at their request, to the user of the PPE-SL or to the agents responsible for inspection.

Le responsable de la location ou de la mise à disposition réitérée d’un EPI-SL d’occasion s’assure que cet EPI-SL répond aux conditions précisées par le fabricant dans la notice visée au point 1. 4 de l’annexe III-5 de la partie réglementaire du code du sport.

Un arrêté des ministres chargés respectivement de l’industrie et du travail précise les éléments dont ce responsable dispose afin d’établir le maintien de l’EPI-SL en conformité. Ce responsable communique lesdits éléments, à leur demande, à l’utilisateur de l’EPI-SL ou aux agents chargés du contrôle.
