Article R3221-17 of the French Public Health Code

The handover is recorded in a report drawn up jointly by the representatives of the local authority that owns the property and the representatives of the establishments mentioned in article L. 3221-4.

When the State or the département do not own the property made available, the minutes are drawn up jointly by the State or the département, the owner and the health care organisation.

The report shall specify in particular the extent, legal status and condition of the property made available.

Article R3221-17

La mise à disposition est constatée par un procès-verbal établi contradictoirement entre les représentants de la collectivité propriétaire et ceux des établissements mentionnés à l’article L. 3221-4.

Lorsque l’Etat ou le département ne sont pas propriétaires des biens mis à disposition, le procès-verbal est établi contradictoirement entre l’Etat ou le département, le propriétaire et l’établissement de santé.

Le procès-verbal précise notamment la consistance, la situation juridique et l’état des biens mis à disposition.
