Article R3222-5 of the French Public Health Code

The medical monitoring committee may examine the situation of a patient hospitalised in the unit for difficult patients in the department where it is located at any time. It examines the file of each patient hospitalised in the unit at least every six months. It informs the departmental commission for psychiatric care of its findings.

The matter may also be referred to it by

1° By the person hospitalised in the unit, his/her family, his/her legal representative if he/she is a minor, the person responsible for his/her legal protection if he/she is the subject of such a measure, or his/her close relatives ;

2° By the public prosecutor responsible for the place of origin or reception ;

3° By the Prefect of the home or host département or, in Paris, by the Police Prefect;

4° By the psychiatrist in charge of the unit ;

5° By the general practitioner or psychiatrist in private practice treating the patient;

6° By the psychiatrist of the health establishment in which the patient was initially treated;

7° By the director of the establishment where the unit is located;

8° By the director of the health establishment in which the patient was initially treated.

Article R3222-5

La commission du suivi médical peut se saisir à tout moment de la situation d’un patient hospitalisé dans l’unité pour malades difficiles de son département d’implantation. Elle examine au moins tous les six mois le dossier de chaque patient hospitalisé dans l’unité. Elle informe la commission départementale des soins psychiatriques des conclusions des examens auxquels elle procède.

Elle peut, en outre, être saisie :

1° Par la personne hospitalisée dans l’unité, sa famille, son représentant légal si elle est mineure, la personne chargée à son égard de la mesure de protection juridique relative à la personne si elle fait l’objet d’une telle mesure ou ses proches ;

2° Par le procureur de la République compétent du lieu d’origine ou d’accueil ;

3° Par le préfet du département d’origine ou d’accueil ou, à Paris, par le préfet de police ;

4° Par le psychiatre responsable de l’unité ;

5° Par le médecin généraliste ou le psychiatre exerçant dans le secteur privé traitant le patient ;

6° Par le psychiatre de l’établissement de santé dans lequel le patient était initialement pris en charge ;

7° Par le directeur de l’établissement où est implantée l’unité ;

8° Par le directeur de l’établissement de santé dans lequel le patient était initialement pris en charge.
