Article R330-3 of the French Monetary and Financial Code

Any person participating in one of the systems referred to in Article R. 330-1 is required to provide any requesting party with information about the system and its operating rules, where such requesting party has a legitimate interest. This information relates to the terms and conditions of membership, the currencies or financial instruments traded, the transactions carried out, the status of the settlement agent, the risk management mechanisms, the procedures for ensuring the irrevocability of payment and delivery instructions for financial instruments, and payments and deliveries of financial instruments.

Where appropriate, this obligation may be met by referring to the operating rules published by the Autorité des marchés financiers.

Toute personne participant à un des systèmes mentionnés à l’article R. 330-1 est tenue de fournir à tout demandeur, y ayant un intérêt légitime, des informations sur ce système et sur ses règles de fonctionnement. Ces informations sont relatives aux conditions et modalités d’adhésion, aux devises ou aux instruments financiers traités, aux opérations effectuées, au statut de l’agent de règlement, aux mécanismes de gestion des risques, aux modalités propres à assurer le caractère irrévocable des instructions de paiement et de livraison d’instruments financiers, ainsi que des paiements et des livraisons d’instruments financiers.

Il peut, le cas échéant, être satisfait à cette obligation par un renvoi aux règles de fonctionnement publiées par l’Autorité des marchés financiers.
