The fact that an advertiser distributes or causes to be distributed advertising that does not comply with the obligations set out in the provisions of article L. 312-41 is punishable by a fine for a 5th class offence.

Article R341-7

Le fait pour l’annonceur de diffuser ou de faire diffuser une publicité non conforme aux obligations prévues aux dispositions de l’article L. 312-41 est puni de la peine d’amende prévue pour les contraventions de la 5e classe.
Le tribunal peut également ordonner la publication du jugement et la rectification de la publicité aux frais du condamné.
