Article R3411-21 of the French Public Health Code

If, during an inspection, the Minister for Health finds that the compensation paid exceeds the net costs incurred in providing the service of general economic interest, he will require the party responsible for placing the product on the market to reimburse the overcompensation and the parameters for calculating the compensation will be updated for the future.

Where the amount of overcompensation does not exceed 10% of the amount of average annual compensation, the overcompensation may be carried forward, by decision of the Minister for Health, to the following period and deducted from the amount of compensation due for that period.

Si, à l’occasion d’un contrôle, le ministre chargé de la santé constate que la compensation versée excède les coûts nets occasionnés par l’exécution du service économique d’intérêt général, il exige du responsable de la mise sur le marché le remboursement de la surcompensation et les paramètres de calcul de la compensation sont mis à jour pour l’avenir.

Lorsque le montant de la surcompensation ne dépasse pas 10 % du montant de la compensation annuelle moyenne, la surcompensation peut être reportée, sur décision du ministre chargé de la santé, sur la période suivante et déduite du montant de la compensation due pour cette période.
