Article R3413-6 of the French Public Health Code

The following doctors may not be appointed as relay doctors for a given person:

– who is related to the person subject to a therapeutic restraining order by blood or marriage up to the fourth degree or who is a hierarchical relative;

– or who is the treating doctor for this person within the meaning ofarticle L. 162-5-3 of the Social Security Code or who usually provides care for this person.

The relay doctor may not ensure the treatment or medical supervision of the person subject to the therapeutic injunction measure.

Article R3413-6

Ne peut être désigné comme médecin relais, pour une personne déterminée, un médecin :

– qui présente avec la personne soumise à une mesure d’injonction thérapeutique un lien de parenté ou d’alliance jusqu’au quatrième degré ou un lien de hiérarchie ;

– ou qui est le médecin traitant de cette personne au sens de l’article L. 162-5-3 du code de la sécurité sociale ou qui lui dispense habituellement des soins.

Le médecin relais ne peut assurer le traitement ou la surveillance médicale de la personne soumise à la mesure d’injonction thérapeutique.
