Article R3413-7 of the French Public Health Code

If the number of relay doctors on the list appears to be insufficient, the Director General of the Regional Health Agency may appoint a relay doctor from the list drawn up in another département, unless he/she refuses.

Failing this, he will designate, with the approval of the public prosecutor at the court of appeal, for a period of no more than one year, a doctor who meets the conditions defined in article R. 3413-2, after first obtaining his agreement.

In the cases referred to in articles R. 3413-4 and R. 3413-5 and if he is unable to attend, the Director General of the Regional Health Agency shall appoint another relay doctor.

Article R3413-7

Lorsque le nombre de médecins relais inscrits sur la liste paraît insuffisant, le directeur général de l’agence régionale de santé peut désigner, sauf refus de sa part, un médecin relais inscrit sur la liste établie dans un autre département.

A défaut, il désigne, sur avis conforme du procureur général près la cour d’appel, pour une durée qui ne peut excéder un an, un médecin remplissant les conditions définies à l’article R. 3413-2 après avoir préalablement recueilli son accord.

Dans les cas mentionnés aux articles R. 3413-4 et R. 3413-5 ainsi qu’en cas d’empêchement, le directeur général de l’agence régionale de santé désigne un autre médecin relais.
