Article R342-17 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When the first president of the court of appeal or his delegate does not intend to reject, pursuant to article L. 342-14, the declaration of appeal without a hearing, the clerk of the court of appeal informs the parties and the public prosecutor of the date and time of the hearing on the merits.

Article R342-17

Lorsque le premier président de la cour d’appel ou son délégué n’envisage pas de rejeter, en application de l’article L. 342-14, la déclaration d’appel sans audience, le greffier de la cour d’appel fait connaître aux parties et au ministère public la date et l’heure de l’audience au fond.
Le préfet de département ou, à Paris, le préfet de police, l’autorité qui a ordonné le placement en zone d’attente, l’avocat de l’étranger et l’étranger lui-même peuvent demander à être entendus à l’audience. Le ministère public peut faire connaître son avis.
