The order of the liberty and custody judge is made within twenty-four hours of its referral or, where the needs of the investigation so require, within forty-eight hours thereof. It is notified on the spot to the parties present at the hearing, who acknowledge receipt. The judge orally informs the parties present of the time limit for appeal and the procedures for lodging an appeal. At the same time, he or she informs them that only an appeal lodged by the public prosecutor can be declared suspensive by the first president of the court of appeal or his or her delegate.
The notifications provided for in the first paragraph are made by any means and as soon as possible to the parties who have not appeared, although duly summoned, as well as to the public prosecutor and the departmental prefect or, in Paris, the police prefect, who acknowledge receipt.
