In establishments whose employees are subject to the Labour Code, the plan to make a smoking area available and the procedures for its implementation are subject to consultation with the Health, Safety and Working Conditions Committee or, failing this, with the staff representatives and the occupational physician.
In public administrations and establishments whose staff are covered by Titles I to IV of the General Statute of the Civil Service, the plan to make a smoking area available and the procedures for its implementation are submitted for consultation to the relevant specialist health, safety and working conditions committee or, in its absence, to the relevant administrative social committee.
The consultations mentioned in the previous paragraphs are repeated every two years.
