The coordinating doctor is appointed by order of the sentence enforcement judge. As far as possible, this appointment is made before the release of a convicted prisoner. However, when the person has been convicted of a crime mentioned inarticle 706-53-13 of the Code of Criminal Procedure, this appointment must be made before the person concerned is released or before the end of his detention period.
The sentence enforcement judge may not appoint as coordinating doctor a practitioner who :
1° Has a family relationship, alliance or professional interest with the convicted person ;
2° Is the sentenced person’s treating physician
3° Has been appointed to carry out his expert assessment during the legal proceedings.
The coordinating doctor may not become the person’s treating doctor or be appointed to carry out the person’s expert assessment during the socio-judicial supervision.
An order issued by the Minister for Health sets the number of persons that a coordinating doctor may monitor simultaneously.
