Book VII: Prevention of sexual offences, treatment orders and socio-judicial supervision

The list of coordinating doctors provided for in article L. 3711-1 is drawn up every three years by the public prosecutor after consulting the departmental medical association and the director general of the regional health agency. It may be regularly updated.

A coordinating doctor may be included on the lists of several judicial courts. Where there are several judicial courts in the département, a list is drawn up for each court. A common list for the department may be drawn up jointly by the competent public prosecutors.

Psychiatrists may be included on the list of coordinating doctors, at their request: 1° Registered with the Order of Physicians ; 2° Have been practising as a specialist for at least three years or have practised as a specialist for at least five years; 3° Have not been convicted of an offence contrary to honour, probity or accepted principles of morality that warrants entry in bulletin no. 2 of the…

When a hospital practitioner performs the duties of coordinating doctor, these duties are performed within the framework of the tasks defined in 5° of article R. 6152-24.

Any practitioner wishing to act as coordinating doctor must submit a request to the public prosecutor. A coordinating doctor may be struck off the register if one of the conditions set out in article R. 3711-3 is no longer met. It is decided by the competent public prosecutor(s). It may also be the subject of a reasoned request from the sentence enforcement judge, the juvenile judge or the prefect if the coordinating doctor fails to fulfil his obligations. A coordinating doctor may withdraw from the list. He shall inform the State Prosecutor, the sentence enforcement judge(s) who appointed him, as well as the doctors treating him and the persons who are in contact with him, by registered letter with acknowledgement of receipt. His withdrawal takes effect three months after he has informed the persons mentioned in the previous paragraph.

The coordinating doctor is appointed by order of the sentence enforcement judge. As far as possible, this appointment is made before the release of a convicted prisoner. However, when the person has been convicted of a crime mentioned inarticle 706-53-13 of the Code of Criminal Procedure, this appointment must be made before the person concerned is released or before the end of his detention period. The sentence enforcement judge will send the coordinating doctor a copy of the documents in the proceedings that are useful for the performance of his duties. The coordinating doctor returns these documents to the judge when he ceases to monitor the person.
