Article R3711-12 of the French Public Health Code

The coordinating doctor appointed by the sentence enforcement judge will summon the person subject to a treatment order to an interview, during which he will inform him of the procedures for implementing this measure and invite him to choose a treating doctor.

If the person is a minor, the choice of attending physician is made by the holders of parental authority or, failing this, by the guardianship judge. The minor’s agreement to this choice is sought.

When the person is an adult subject to a legal protection measure with representation relating to the person, and is not capable of expressing his or her wishes, this choice is made, under the same conditions, by the person in charge of the measure, taking into account the opinion of the adult. Except in emergencies, in the event of disagreement between the protected adult and the person responsible for his or her protection, the judge will authorise one or other of them to make the decision.

The coordinating doctor may refuse to endorse the person’s choice of attending doctor if he or she considers that the latter is clearly unable to provide the person with care.

Le médecin coordonnateur désigné par le juge de l’application des peines convoque la personne soumise à une injonction de soins pour un entretien au cours duquel il lui fait part des modalités d’exécution de cette mesure et l’invite à choisir un médecin traitant.

Lorsque la personne est mineure, le choix du médecin traitant est effectué par les titulaires de l’autorité parentale ou, à défaut, par le juge des tutelles. L’accord du mineur sur ce choix est recherché.

Lorsque la personne est un majeur faisant l’objet d’une mesure de protection juridique avec représentation relative à la personne, et n’est pas apte à exprimer sa volonté, ce choix est effectué, dans les mêmes conditions, par la personne chargée de la mesure, en tenant compte de l’avis du majeur. Sauf urgence, en cas de désaccord entre le majeur protégé et la personne chargée de sa protection, le juge autorise l’un ou l’autre à prendre la décision.

Le médecin coordonnateur peut refuser d’avaliser le choix d’un médecin traitant par la personne s’il estime que celui-ci n’est manifestement pas en mesure d’assurer la prise en charge de cette dernière.
