The coordinating doctor appointed by the sentence enforcement judge will summon the person subject to a treatment order to an interview, during which he will inform him of the procedures for implementing this measure and invite him to choose a treating doctor.
If the person is a minor, the choice of attending physician is made by the holders of parental authority or, failing this, by the guardianship judge. The minor’s agreement to this choice is sought.
When the person is an adult subject to a legal protection measure with representation relating to the person, and is not capable of expressing his or her wishes, this choice is made, under the same conditions, by the person in charge of the measure, taking into account the opinion of the adult. Except in emergencies, in the event of disagreement between the protected adult and the person responsible for his or her protection, the judge will authorise one or other of them to make the decision.
The coordinating doctor may refuse to endorse the person’s choice of attending doctor if he or she considers that the latter is clearly unable to provide the person with care.
