Article R412-2 of the French Cinema and Moving Image Code

The protocol includes a clause stipulating that the persons mentioned in Article L. 412-3 shall, in the performance of their duties, ensure that there is no conflict of interest.
To this end, before a technical expertise assignment is entrusted to him/her, the prospective person shall confirm to the Chairman of the Centre national du cinéma et de l’image animée that he/she has no professional relations over the previous three years with the person who is to be the subject of the technical expertise assignment.
The Chairman of the Centre national du cinéma et de l’image animée may not award a technical expertise assignment to a person who, during the period under consideration, has controlled the person who is to be the subject of the technical expertise assignment or who has provided a service on his behalf or on behalf of another person involved in the procedure.

Le protocole comporte une clause stipulant que les personnes mentionnées à l’article L. 412-3 veillent, dans le cadre de l’exercice de leur mission, à éviter tout conflit d’intérêts.
A cette fin, avant qu’une mission d’expertise technique lui soit confiée, la personne pressentie confirme au président du Centre national du cinéma et de l’image animée l’absence de relations professionnelles au cours des trois années précédentes avec la personne appelée à être l’objet de la mission d’expertise technique.
Le président du Centre national du cinéma et de l’image animée ne peut lui confier une mission d’expertise technique si, au cours de la période considérée, elle a contrôlé la personne appelée à être l’objet de la mission d’expertise technique ou si elle a effectué une prestation pour son compte ou pour le compte d’une autre personne concernée par la procédure.
