Article R413-7 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Article R. 413-6 does not apply when the foreign national resides in France under the following residence permits:
1° The temporary residence permit bearing the wording “temporary worker” provided for in article L. 421-3;
2° The temporary residence permit bearing the wording “student” provided for in articles L. 422-1 or L. 422-2;
3° The temporary residence permit bearing the wording “student-mobility programme” provided for in article L. 422-5;
4° The temporary residence permit bearing the wording “private and family life” provided for in articles L. 423-13 or L. 425-9;
5° The temporary residence permit bearing the wording “visitor” provided for in article L. 426-20;
6° The temporary residence permit bearing the wording “trainee” provided for in article L. 426-23;
7° The multi-annual residence permit bearing the wording “seasonal worker” provided for in article L. 421-34.

L’article R. 413-6 ne s’applique pas lorsque l’étranger réside en France sous couvert des cartes de séjour suivantes :
1° La carte de séjour temporaire portant la mention ” travailleur temporaire ” prévue à l’article L. 421-3 ;
2° La carte de séjour temporaire portant la mention ” étudiant ” prévue aux articles L. 422-1 ou L. 422-2 ;
3° La carte de séjour temporaire portant la mention ” étudiant-programme de mobilité ” prévue à l’article L. 422-5 ;
4° La carte de séjour temporaire portant la mention ” vie privée et familiale ” prévue aux articles L. 423-13 ou L. 425-9 ;
5° La carte de séjour temporaire portant la mention ” visiteur ” prévue à l’article L. 426-20 ;
6° La carte de séjour temporaire portant la mention ” stagiaire ” prévue à l’article L. 426-23 ;
7° La carte de séjour pluriannuelle portant la mention ” travailleur saisonnier ” prévue à l’article L. 421-34.
