Article R421-10 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When applying for the issue or renewal of the residence permit provided for in article L. 421-5, the prefect shall check that the activity in question is compatible with public safety, health and tranquillity and, where applicable, that there are no convictions or rulings prohibiting the exercise of a commercial activity in France.

Lors de la demande de délivrance ou de renouvellement de la carte de séjour prévue à l’article L. 421-5, le préfet vérifie la compatibilité de l’activité en cause avec la sécurité, la salubrité et la tranquillité publiques ainsi que, le cas échéant, l’absence de condamnation ou de décision emportant l’interdiction d’exercer une activité commerciale en France.
