Article R421-9 of the French Intellectual Property Code

The application for registration shall be submitted to the Director General of the National Institute of Industrial Property. It shall be accompanied by proof that the conditions laid down in Article R. 421-1, in article R. 421-1-1 or to articles R. 421-7 and R. 421-8.

A receipt is issued for the application.

If the application does not comply, the applicant is notified, stating the reasons. The applicant is given a period in which to rectify the application or contest the Institute’s objections. If the application is not put in order or if no observations are made to remove the objections, it is rejected. The notification may be accompanied by a proposal for rectification. This proposal is deemed to have been accepted if the applicant does not contest it within the time limit set.

La demande d’inscription est présentée au directeur général de l’Institut national de la propriété industrielle. Lui est jointe la justification qu’il est satisfait selon le cas aux conditions prévues à l’article R. 421-1, à l’article R. 421-1-1 ou aux articles R. 421-7 et R. 421-8.

Il est donné récépissé de la demande.

En cas de non-conformité de la demande, notification motivée en est faite au demandeur. Un délai lui est imparti pour régulariser la demande ou contester les objections de l’institut. A défaut de régularisation ou d’observation permettant de lever l’objection, la demande est rejetée. La notification peut être assortie d’une proposition de régularisation. Cette proposition est réputée acceptée si le demandeur ne la conteste pas dans le délai qui lui est imparti.
