Article R4211-32 of the French Public Health Code

I. – The provisions of this section apply to the categories of establishments or organisations defined in the second paragraph of this article which meet the conditions for obtaining the authorisation provided for in I of Article L. 4211-9-1 to prepare, store, distribute and transfer individually prepared advanced therapy medicinal products as defined in 17° of Article L. 5121-1, including in the context of biomedical research as referred to in Article L. 1121-1, as well as, in the same context, to import and export these medicinal products.

Pharmaceutical establishments, health establishments, the Etablissement Français du Sang (French Blood Establishment), the Armed Forces Blood Transfusion Centre and, when the purpose of these establishments, foundations or associations is health or biomedical research, public scientific and technological establishments, scientific cooperation foundations governed by articles L. 344-11 et seq. of the Research Code, public interest foundations governed by law no. 87-571 of 23 July 1987 on the development of sponsorship and associations governed by the law of 1 July 1901.

II – For the purposes of this section, the following definitions apply

1° Advanced therapy medicinal products prepared on an ad hoc basis: advanced therapy medicinal products as defined in 17° of article L. 5121-1 ;

2° Transfer: the transfer of punctually prepared advanced therapy medicinal products from an establishment or organisation authorised pursuant to this section to another establishment or organisation authorised pursuant to this section;

3° Distribution: making available an individually prepared advanced therapy medicinal product on medical prescription with a view to its administration to a specific patient.

Article R4211-32

I. ― Les dispositions de la présente section s’appliquent aux catégories d’établissements ou d’organismes définis au deuxième alinéa du présent article qui remplissent les conditions pour bénéficier de l’autorisation prévue au I de l’article L. 4211-9-1 pour procéder à la préparation, à la conservation, à la distribution et à la cession des médicaments de thérapie innovante préparés ponctuellement définis au 17° de l’article L. 5121-1, y compris dans le cadre d’une recherche biomédicale mentionnée à l’article L. 1121-1, ainsi que, dans le même cadre, à l’importation et à l’exportation de ces médicaments.

Peuvent être autorisés à procéder à l’une ou l’autre de ces activités les établissements pharmaceutiques, les établissements de santé, l’Etablissement français du sang, le centre de transfusion sanguine des armées ainsi que, lorsque ces établissements, fondations ou associations ont pour objet la santé ou la recherche biomédicale, les établissements publics à caractère scientifique et technologique, les fondations de coopération scientifique régies par les articles L. 344-11 et suivants du code de la recherche, les fondations d’utilité publique régies par la loi n° 87-571 du 23 juillet 1987 sur le développement du mécénat et les associations régies par la loi du 1er juillet 1901.

II. ― Pour l’application de la présente section, on entend par :

1° Médicaments de thérapie innovante préparés ponctuellement : les médicaments de thérapie innovante définis au 17° de l’article L. 5121-1 ;

2° Cession : le transfert de médicaments de thérapie innovante préparés ponctuellement d’un établissement ou d’un organisme autorisé en application de la présente section vers un autre établissement ou organisme autorisé en application de cette même section ;

3° Distribution : la mise à disposition d’un médicament de thérapie innovante préparé ponctuellement sur prescription médicale en vue de son administration à un patient déterminé.
