Article R4211-51 of the French Public Health Code

An authorised establishment or organisation may transfer to another authorised establishment or organisation advanced therapy medicinal products prepared on an ad hoc basis with a view to their storage and distribution or components of these medicinal products with a view to their preparation by this second establishment or organisation.

Only advanced therapy medicinal products prepared on an ad hoc basis in compliance with the health safety rules adopted in application of Article L. 1211-6, prepared in accordance with the rules of good practice provided for in Article L. 5121-5 and meeting the requirements mentioned in the authorisation provided for in 17° of Article L. 5121-1 may be transferred with a view to distribution.

Only advanced therapy medicinal products prepared on an ad hoc basis or components of these medicinal products which comply with the quality and health safety rules adopted in application of article L. 1211-6 and prepared in accordance with the rules of good practice provided for in article L. 5121-5 may be transferred with a view to being prepared by the establishment or organisation to which they are transferred, under the conditions laid down in agreements between the two establishments or organisations.

Un établissement ou un organisme autorisé peut céder à un autre établissement ou organisme autorisé des médicaments de thérapie innovante préparés ponctuellement en vue de leur conservation et de leur distribution ou des composants de ces médicaments en vue de leur préparation par ce second établissement ou organisme.

Ne peuvent être cédés en vue d’être distribués que les médicaments de thérapie innovante préparés ponctuellement conformes aux règles de sécurité sanitaire prises en application de l’article L. 1211-6, préparés conformément aux règles de bonnes pratiques prévues à l’article L. 5121-5 et répondant aux exigences mentionnées dans l’autorisation prévue au 17° de l’article L. 5121-1.

Ne peuvent être cédés en vue d’être préparés par l’établissement ou l’organisme à qui ils sont cédés, dans les conditions prévues par des conventions entre les deux établissements ou organismes, que les médicaments de thérapie innovante préparés ponctuellement ou des composants de ces médicaments conformes aux règles de qualité et de sécurité sanitaire prises en application de l’article L. 1211-6 et préparés conformément aux règles de bonnes pratiques prévues à l’article L. 5121-5.
