Article R422-51-9 of the French Intellectual Property Code

Each financial holding company of the liberal profession of industrial property attorney is subject, by the Director General of the National Institute of Industrial Property, as soon as it is registered and then at least once every four years thereafter, to an inspection relating to compliance with the legislative and regulatory provisions applicable to it.

During each inspection, the opinion of the Compagnie nationale des conseils en propriété industrielle is requested. The opinion is deemed to have been given if the company has not formulated it within one month of its referral.

In the event of non-compliance with the legislative and regulatory provisions in force, the procedure provided for in Article R. 422-51-8 shall be applied.

Chaque société de participations financières de la profession libérale de conseil en propriété industrielle fait l’objet, par le directeur général de l’Institut national de la propriété industrielle, dès son inscription puis ensuite au moins une fois tous les quatre ans, d’un contrôle portant sur le respect des dispositions législatives et réglementaires qui lui sont applicables.

Au cours de chaque contrôle, l’avis de la Compagnie nationale des conseils en propriété industrielle est demandé. L’avis est réputé donné si la compagnie ne l’a pas formulé dans le délai d’un mois à compter de sa saisine.

En cas de non-respect des dispositions législatives et réglementaires en vigueur, il est fait application de la procédure prévue à l’article R. 422-51-8.
