Article R422-60 of the French Intellectual Property Code

The summons to the hearing before the Disciplinary Board is sent by the Secretariat to the industrial property agent being prosecuted, at least one month before the hearing. It is accompanied by the report filed by the rapporteur. The observations received from the parties are annexed to the report.
Where the person being prosecuted is a legal entity, the summons is sent under the same conditions to its legal representative.

The summons, together with the report submitted by the rapporteur, is sent to the legal representative.
The summons, together with the report and the appendix, shall be notified to the authority that referred the matter to the Board or to the person who lodged the complaint.

A period of one month from the date of the summons shall elapse between the date of the report and the date of the summons.
The person who lodged the complaint or referred the matter to the Board and the person being prosecuted are given one month from the date of notification to submit any written observations.

The file is also sent to the members of the Board.
The file is also given to the members of the Chamber.

La convocation à l’audience devant la chambre de discipline est adressée par le secrétariat au conseil en propriété industrielle poursuivi, au moins un mois avant l’audience. Elle est accompagnée du rapport déposé par le rapporteur. Les observations reçues des parties figurent en annexe du rapport.


Lorsque la personne poursuivie est une personne morale, la convocation est adressée dans les mêmes conditions à son représentant légal.


La convocation, accompagnée du rapport et de l’annexe, est notifiée à l’autorité qui a saisi la chambre ou à l’auteur de la plainte.


Un délai d’un mois à compter de cette notification est imparti à l’auteur de la plainte ou de la saisine et à la personne poursuivie, pour produire d’éventuelles observations écrites.


Le dossier est également remis aux membres de la chambre.
