The deliberation takes place without the presence of the parties. The rapporteur and the secretary of the chamber shall not take part in the deliberation.
The decision shall state the reasons on which it is based. It is taken by a simple majority. However, temporary disbarment for more than one year or permanent disbarment may only be decided by a majority of five members, or four members where the Disciplinary Board sits as a select committee.
The decision shall be notified by the Secretariat to the industrial property attorney being prosecuted, to the author of the complaint or referral, to the Director General of the National Institute of Industrial Property, to the President of the National Association of Industrial Property Attorneys, to the Minister of Justice and to the Minister responsible for industrial property, within eight days of its pronouncement.
The decision is enforceable from the date of its notification to the person concerned.
The decision may be referred to the Court of Appeal.
The decision may be referred to the Conseil d’Etat by way of an appeal on points of law within the time limits under ordinary law provided for by article R. 821-1 of the Code of Administrative Justice.
