Article R4221-13-7 of the French Public Health Code

The Director General of the Centre national de gestion, acting on behalf of the Minister for Health, issues the practice authorisations provided for in article L. 4221-9, after obtaining the opinion of the practice authorisation commission referred to in article D. 4221-1 , on the basis of an application submitted and examined in accordance with the procedures laid down by the order referred to in article R. 4221-14.

The applications are sent to the national management centre, which acknowledges receipt of the application within one month of receipt.

If the competent authority does not respond within six months of receiving a complete application, the application will be rejected.

Article R4221-13-7

Le directeur général du Centre national de gestion, au nom du ministre chargé de la santé, délivre, après avis de la commission d’autorisation d’exercice mentionnée à l’article D. 4221-1, les autorisations d’exercice prévues à l’article L. 4221-9, au vu d’un dossier présenté et instruit selon des modalités fixées par l’arrêté mentionné à l’article R. 4221-14.

Les dossiers sont adressés au centre national de gestion qui accuse réception de la demande dans le délai d’un mois à compter de sa réception.

Le silence gardé par l’autorité compétente à l’expiration d’un délai de six mois à compter de la réception d’un dossier complet vaut décision de rejet de la demande.
