Article R4221-15-5 of the French Public Health Code

A pharmacist who has been the subject of a total or partial suspension of the right to practise may not resume his activity without having provided proof to the competent regional or central council that he has fulfilled the training obligations laid down by the decision. In this case, the council decides that the pharmacist is fit to practise and informs the authorities who were notified of the suspension.

If it appears that the obligations laid down by the decision of the competent regional or central council, or, in the case of VI of article R. 4221-15-4, of the national council, have not been fulfilled, the suspension of the person concerned is extended by the competent regional or central council until that council has taken a decision in accordance with the conditions laid down in article R. 4221-15-4.

Le pharmacien qui a fait l’objet d’une mesure de suspension totale ou partielle du droit d’exercer ne peut reprendre son activité sans avoir justifié auprès du conseil régional ou central compétent avoir rempli les obligations de formation fixées par la décision. Dans ce cas, le conseil décide que le pharmacien est apte à exercer sa profession et en informe les autorités qui ont reçu notification de la suspension.


S’il apparaît que les obligations posées par la décision du conseil régional ou central compétent, ou, dans le cas du VI de l’article R. 4221-15-4, du conseil national, n’ont pas été satisfaites, la suspension de l’intéressé est prolongée par le conseil régional ou le conseil central compétent jusqu’à ce que ce conseil se soit prononcé dans les conditions prévues par l’article R. 4221-15-4.
