Article R4221-20 of the French Public Health Code

If the pharmacist suspended in application of article L. 4221-18 is a civil servant, the hierarchical authority shall maintain his salary, residence allowance, family salary supplement and compulsory family benefits and, if he is not a civil servant, his monthly emoluments.

If the pharmacist suspended in application of article L. 4221-18 is an employee subject to the Labour Code, the employer will maintain his salary during the period of precautionary lay-off.

Article R4221-20

Lorsque le pharmacien suspendu en application de l’article L. 4221-18 a la qualité d’agent de droit public, l’autorité investie du pouvoir hiérarchique lui maintient, lorsqu’il est fonctionnaire, son traitement ainsi que l’indemnité de résidence, le supplément familial de traitement et les prestations familiales obligatoires et, lorsqu’il n’est pas fonctionnaire, ses émoluments mensuels.

Lorsque le pharmacien suspendu en application de l’article L. 4221-18 a la qualité de salarié soumis au code du travail, l’employeur lui maintient son salaire pendant la période de mise à pied conservatoire.
