Article R427 of the French Code of Criminal Procedure

The first paragraph of Article R. 234 is worded as follows:

“In the case of a certified statement or statement of account, the accounting officer assigned before payment or the stakeholder, within a period of one month from the collection of the sum, may submit a complaint to the public prosecutor, who shall refer the matter to the taxing magistrate with his requisitions.”

L’alinéa premier de l’article R. 234 est rédigé comme suit :

” S’agissant d’un mémoire ou d’un état certifié, le comptable assignataire avant paiement ou la partie prenante, dans le délai d’un mois à compter de la perception de la somme, peuvent adresser une réclamation au ministère public, qui saisit de ses réquisitions le magistrat taxateur “.
